2022 Smoke alarm legislation

From January 2022 there will be new, stricter smoke alarm laws for all rental properties in QLD.

If you are a landlord or property manager now is the time to act to avoid the rush and/or extra expense

WHAT ARE THE CHANGES?

For all rental properties smoke alarms will need to be:

  • Photoelectric rather than ionisation
  • 10 years old or less
  • Interconnected to each other
  • On every level in a dwelling
  • In every bedroom and hallways that connect to a bedroom
  • Compliant with AS3786:2014.

Smoke alarms must be installed on each storey:

  • in each bedroom; and
  • in hallways which connect bedrooms and the rest of the dwelling; or
  • if there is no hallway, between the bedrooms and other parts of the storey; and
  • if there are no bedrooms on a storey at least one smoke alarm must be installed in the most likelypath of travel to exit the dwelling.

Smoke alarms must be hardwired or powered by a non-removable 10-year battery.

WHAT IF MY RENTAL PROPERTY IS NOT COMPLIANT BY 2022?

QFES will fine landlords $500 if their property is not compliant. Agencies that rent out a non compliant property can be fined up to $100,000
